Can I charge interest on a late invoice in the UK?

The short answer

Usually, yes. If your contract sets no other rate, a business can claim statutory interest on a late payment from another business. The rate is 8% plus the Bank of England base rate. You can also claim a fixed sum of £40, £70 or £100, depending on the size of the debt.

Who it applies to

These rights cover payments for goods or services between businesses. They do not cover sales to consumers. If your contract sets a different rate of interest, you cannot claim statutory interest as well: the contract rate applies.

When a payment is late

A payment is late after the date you agreed. If you did not agree a date, GOV.UK says it is usually late 30 days after the customer gets the invoice or the work is done, whichever is later. Interest runs from that point until the customer pays.

The fixed sum

On top of interest, you can claim a fixed sum for the cost of recovering the debt: £40, £70 or £100, depending on how much is owed. You can claim it once for each payment. You may be able to claim reasonable extra costs too.

Should you charge it?

It is your choice. Interest can speed up a slow payer, but it can also strain a good customer relationship. Many firms mention the right in their terms and on a final notice, then decide case by case.
